Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the Loan Intel loan book intelligence platform (the “Platform”) operated by TP Commercial Finance Ltd (“TPCF”, “we”, “us”). This AUP forms part of the Terms & Conditions you agreed to on registration. By accessing the Platform, you agree to comply with this policy.

1. Permitted Use

The Platform is designed exclusively for use by UK-based lending institutions, insurance providers, and professional advisors operating in the specialist lending market. Permitted uses include:

  • Accessing cross-lender credit intelligence and risk analytics for the purpose of credit risk assessment on corporate borrowers and SPVs
  • Submitting loan performance data, payment status updates, and decline records in respect of your institution's corporate lending portfolio
  • Searching and reviewing company-level financial data, including charge register information, corporate group structures, and Experian commercial credit scores
  • Accessing market intelligence reports, trend data, and aggregated analytics produced by the Platform
  • Managing your organisation's account, user access, and notification preferences
  • Generating data exports for internal risk reporting, regulatory submissions, or management information purposes

All use of the Platform must be for lawful purposes, in good faith, and in compliance with applicable laws including the Financial Services and Markets Act 2000, UK GDPR, and any applicable FCA rules and guidance.

2. Prohibited Activities

The following activities are strictly prohibited. Engaging in any of the following may result in immediate account suspension and may give rise to civil or criminal liability:

Data Misuse & Extraction

  • Scraping and automated extraction: You must not use web scraping tools, bots, spiders, crawlers, or any automated method to extract, copy, or harvest data from the Platform beyond what is accessible through authorised API or export functionality.
  • Bulk downloading: Systematically downloading large volumes of Platform data for the purpose of creating a competing database or intelligence product is prohibited.
  • Data resale: You must not resell, sublicense, or commercially distribute Platform data to third parties without our prior written consent.
  • Redistribution: Sharing Platform data with organisations that are not party to a valid subscription agreement is prohibited.

Account & Access Security

  • Credential sharing: You must not share your login credentials with any person who is not an Authorised User under your organisation's subscription. Each user must hold an individual account.
  • Account transfer: You must not transfer your account to a different individual or organisation without our written consent.
  • Circumventing access controls: Attempting to bypass authentication, authorisation checks, or other security controls is strictly prohibited.
  • Concurrent access abuse: Using a single account from multiple simultaneous sessions in a manner that circumvents per-seat licence limits is prohibited.

Technical Abuse

  • Reverse engineering: You must not attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform or its underlying algorithms.
  • Denial of service: You must not conduct or facilitate denial-of-service attacks, or any activity designed to disrupt, degrade, or overload Platform infrastructure.
  • Vulnerability exploitation: You must not exploit any security vulnerability in the Platform. If you discover a vulnerability, you must report it in accordance with our Responsible Disclosure Policy.
  • Injecting malicious code: Uploading, transmitting, or introducing viruses, malware, ransomware, or any other malicious code is prohibited.

Unlawful & Harmful Use

  • Using the Platform to facilitate market abuse, insider dealing, or any activity that would constitute a financial crime under UK law
  • Submitting false, misleading, or fraudulent loan data to the Platform with intent to deceive other lenders or manipulate market intelligence
  • Using the Platform in a manner that infringes the intellectual property rights of TPCF or any third party
  • Using the Platform to target, harass, or discriminate against any individual or organisation
  • Any use that would violate applicable sanctions, anti-money laundering legislation, or other financial crime regulations

3. Data Submission Standards

When contributing loan data to the Platform, you warrant that:

  • All data submitted is accurate, complete, and up to date to the best of your knowledge
  • You have the authority and, where required, the legal right to share the data with TPCF
  • The data does not contain personal data of natural persons (including guarantor names or personal contact details) beyond what is strictly necessary and permitted under applicable law
  • Your submission complies with any confidentiality obligations you may owe to borrowers, provided that such obligations do not conflict with the legitimate purpose of credit risk information sharing under applicable law

4. Enforcement

We take violations of this AUP seriously. On becoming aware of a potential breach, we may take any of the following actions, depending on the severity and circumstances of the violation:

  • Warning: For minor or first-time violations, we may issue a formal written warning and require you to remedy the breach within a specified timeframe.
  • Suspension: We may temporarily suspend your account or specific features pending investigation of a suspected violation.
  • Termination: For serious, repeated, or wilful violations, we may terminate your subscription immediately in accordance with the Terms & Conditions, with or without prior notice.
  • Legal action: Where a violation involves fraud, data theft, or other criminal conduct, we reserve the right to report the matter to the relevant authorities and pursue civil remedies.
  • Data removal: We may remove any data submitted to the Platform in breach of this AUP.

Nothing in this AUP limits our rights under the Terms & Conditions, applicable law, or in equity.

5. Reporting Violations

If you become aware of any activity that you believe violates this AUP, including misuse of your own credentials, please report it to us immediately. We treat all reports in confidence.
